the General Office of the State Council) Chapter I General Provisions

Article 1 In order to give full play to the strategic traction role of carbon peak and carbon neutralization, accelerate the construction of a dual-control system of total carbon emissions and intensity, and promote local Party committees and governments to establish and practice correct view of political achievement and resolutely shoulder the responsibility of carbon peak and carbon neutralization, the State Council has adopted the following measures: These Measures are formulated in accordance with the Opinions of the Central Committee of the Communist Party of China and the State Council on Implementing the New Development Concept Completely, Accurately and Comprehensively to Do a Good Job in Carbon Peak and Carbon Neutralization, the Opinions of the Central Committee of the Communist Party of China and the State Council on Accelerating the Comprehensive Green Transformation of Economic and Social Development and relevant provisions. Article

2 These Measures shall be applicable to the evaluation and assessment of the Party committees and governments of all provinces (autonomous regions and municipalities directly under the Central Government) in implementing the target task of carbon peak and carbon neutralization and accelerating the progress of comprehensive green transformation of economic and social development since 2026. Article

3 Under the centralized and unified leadership of the Party Central Committee, the evaluation and assessment work shall be guided by the Central Organization Department as a whole and implemented by the National Development and Reform Commission in conjunction with relevant departments. Article

4 The evaluation and assessment shall be based on the same responsibilities of the Party and the government, one post and two responsibilities, and adhere to the working principles of overall consideration, objectivity and impartiality, scientific norms and effectiveness. Chapter

II Contents

of Evaluation and Assessment Article 5 Evaluation and assessment shall be carried out closely around the implementation of the decision-making and deployment of the Party Central Committee and the State Council on carbon peak and carbon neutrality, as well as the goal of national independent contribution to climate change, so as to promote provinces (autonomous regions and municipalities directly under the Central Government) to implement the dual control target of total carbon emissions and intensity. The

7 During the "Fifteenth Five-Year Plan" period, the National Development and Reform Commission shall, in conjunction with relevant departments, formulate an action plan for the "Fifteenth Five-Year Plan" to achieve the target of carbon peak by 2030 as scheduled. We will ensure that the carbon emission intensity will be reduced by more than 65% in 2030 compared with 2005, and that the proportion of non-fossil energy consumption will reach 25% in 2030. We will achieve the peak of total coal consumption and total oil consumption, rationally control the installed capacity and power generation of coal-fired power, and strive to gradually cover the new electricity consumption of the whole society with new clean energy. Article

8 During the Fifteenth Five-Year Plan period, the Party committees and governments of all provinces (autonomous regions and municipalities directly under the Central Government) shall formulate provincial carbon peak action plans, determine the five-year and annual targets of various indicators in the region in accordance with the objectives at the national level, and put forward corresponding tasks and measures.

The provincial action plan shall be formulated and completed on time, and shall be submitted to the Party Central Committee and the State Council for examination and approval after being examined by the National Development and Reform Commission in conjunction with relevant departments, and shall serve as the basis for subsequent evaluation and assessment of provinces (autonomous regions and municipalities directly under the Central Government). When

the National Development and Reform Commission and relevant departments link up and examine provincial action plans, they should focus on achieving national goals, urge local governments to implement the requirements of carbon emission equivalence or reduction replacement for new (reform and expansion) "two high" industrial projects, and promote the implementation of new "two high" industrial projects. Considering the main function orientation, industrial and energy structure, natural resources endowment and other factors of different types of regions, we should coordinate rigid constraints and flexible regulation to reflect the requirements of differentiation. Article

9 Starting from the "Sixteenth Five-Year Plan" period, in the first year of each five-year planning period, the National Development and Reform Commission shall, in conjunction with relevant departments, formulate a national action plan for carbon emission control in accordance with the phased objectives set by the Party Central Committee and the State Council, and provinces (autonomous regions and municipalities directly under the Central Government) shall formulate provincial action plans for carbon emission control to promote the gradual realization of carbon neutrality. Article

10 The National Development and Reform Commission shall, in conjunction with relevant departments, formulate an annual implementation plan for evaluation and assessment in a timely manner, refine work measures, clarify the detailed rules for evaluation and assessment of various indicators, and timely adjust and improve the index system according to the situation and work needs. Chapter

III Evaluation and Assessment Procedures

Article 11 The evaluation and assessment work shall be carried out annually and implemented in the next year of the evaluation and assessment year. Article

12 The Party committees and governments of all provinces (autonomous regions and municipalities directly under the Central Government) shall conduct self-evaluation of the annual carbon peak and carbon neutralization work in their respective regions, and submit the self-evaluation report to the Party Central Committee and the State Council on time, and copy it to the National Development and Reform Commission and other departments responsible for evaluation and assessment. Article

13 The relevant departments shall evaluate the annual progress of the indicators they are responsible for and the annual progress of the provinces (autonomous regions and municipalities directly under the Central Government). The evaluation results of single indicators of provinces (autonomous regions and municipalities directly under the Central Government) are divided into reaching the standard and failing to reach the standard. If the evaluation result is "not up to the standard", the department responsible for the evaluation and assessment of the relevant indicators shall analyze the problems and causes existing in the work of the province (autonomous region, municipality directly under the Central Government) and put forward suggestions for improvement, and form written opinions. The relevant departments shall submit the evaluation results and written opinions to the National Development and Reform Commission on time. Article

14 The State Development and Reform Commission, in conjunction with relevant departments, shall conduct on-the-spot verification of the progress of work, the implementation of tasks, the completion of objectives and the authenticity of data in relevant provinces (autonomous regions and municipalities directly under the Central Government) by means of spot checks and third-party verification. Article

15 The National Development and Reform Commission shall, in the light of local self-evaluation, departmental evaluation and on-the-spot verification, put forward suggestions on the results of the comprehensive evaluation and assessment of the annual carbon peak and carbon neutralization of provinces (autonomous regions and municipalities directly under the Central Government) in accordance with the three grades of excellence, qualification and disqualification, and report them to the Party Central Committee and the State Council in accordance with the procedures after consulting with the Central Organization Department. The provinces (autonomous regions, municipalities directly under the Central Government) with all

control indicators and supporting indicators up to standard shall be evaluated as "excellent"; the provinces (autonomous regions, municipalities directly under the Central Government) with one or more control indicators or three or more supporting indicators not up to standard shall be evaluated as "unqualified"; and the rest shall be "qualified". Chapter

IV Application

of Evaluation and Assessment Results Article 16 After the evaluation and assessment results are examined and approved by the Party Central Committee and the State Council, the Central Organization Department and the National Development and Reform Commission shall give feedback to the Party committees and governments of all provinces (autonomous regions and municipalities directly under the Central Government) in accordance with the procedures and submit them to the Central Discipline Commission and the State Supervisory Commission. Article

17 The relevant provinces (autonomous regions and municipalities directly under the Central Government) shall be interviewed, reminded and praised according to the results of the evaluation and assessment. If the results of the

evaluation and assessment are "unqualified", the Central Organization Department and the National Development and Reform Commission shall urge the Party committees and governments of the relevant provinces (autonomous regions and municipalities directly under the Central Government) to make written reports to the Party Central Committee and the State Council within 30 working days after receiving the feedback of the results, and put forward rectification measures with a clear time limit for completion. If the overdue rectification is not in place, the Central Organization Department and the National Development and Reform Commission shall interview the Party committees and governments of the provinces (autonomous regions and municipalities directly under the Central Government) with the relevant departments as appropriate. If the

evaluation and assessment results are "qualified" but some indicators are not up to the standard, the relevant departments responsible for the evaluation and assessment of indicators shall notify and remind them within a certain range. If the

evaluation results are "excellent" or the performance of individual indicators is outstanding, the National Development and Reform Commission, together with the relevant departments, shall report and praise them, summarize and publicize them in a timely manner, and promote good experiences and good practices. Article

18 The results of evaluation and assessment shall serve as an important reference for the comprehensive assessment, selection, appointment, supervision and management of Party committees and government leading bodies of provinces (autonomous regions and municipalities directly under the Central Government) and relevant leading cadres. If major dereliction of duty is found in the

evaluation and assessment or in the rectification, the State Development and Reform Commission, together with the relevant departments, shall put forward suggestions for accountability, transfer the relevant issues and factual materials to the State Supervisory Commission of the Central Discipline Commission and the Central Organization Department in accordance with the procedures and regulations, and investigate the responsibility of the relevant units and individuals in accordance with the rules and regulations. The relevant provinces (autonomous regions, municipalities directly under the Central Government) and departments may commend and reward the units and individuals with outstanding performance in the

evaluation and assessment in accordance with the relevant provisions.

The nineteenth evaluation and assessment should be realistic, fair and impartial. If there are such acts as favoritism and fraud, false reporting of underreport, tampering with data and forgery of information, which result in serious distortion of the evaluation results, the evaluation results of the relevant provinces (autonomous regions and municipalities directly under the Central Government) shall be directly determined as "unqualified", and the relevant units and personnel shall be seriously investigated for their responsibilities in accordance with the relevant provisions. Chapter

V Implementation

of Evaluation and Assessment Article 20 Evaluation and assessment are mainly based on national statistical data. If the statistical data are missing or the timeliness cannot meet the needs of evaluation and assessment for the time being, the national carbon market data and the statistics, investigation, monitoring and accounting data of relevant departments may be used.The National Bureau of Statistics and other departments with data shall provide the data required for the evaluation and assessment to the departments responsible for the evaluation and assessment of relevant indicators in a timely manner. Article

21 The National Development and Reform Commission, the Ministry of Ecology and Environment and the National Bureau of Statistics shall continuously improve the statistical accounting system for carbon emissions, and, in conjunction with other departments responsible for evaluation and assessment, continuously improve the ability of data statistics, investigation, monitoring and accounting, and strengthen the data support for evaluation and assessment.

The State Development and Reform Commission, the State Statistical Bureau and the State Energy Administration shall establish a dynamic monitoring and early warning system for important data, regularly monitor the carbon emissions, coal consumption, oil consumption, new electricity consumption and new clean energy power consumption of the whole country and provinces (autonomous regions and municipalities directly under the Central Government), and report on them. The relevant provinces (autonomous regions and municipalities directly under the Central Government) shall be reminded and warned according to the situation. Article

22 Provinces (autonomous regions and municipalities directly under the Central Government) shall, in conjunction with the evaluation and assessment work, coordinate the carbon neutralization, economic and social development and energy security, scientifically and rationally decompose and compact the responsibility for emission reduction, ensure the smooth continuation of the overall transformation from energy consumption control to carbon emission control, and steadily and orderly reduce carbon emissions in traditional industries. We must resolutely curb the blind launching of the "two high" projects. We should adhere to the combination of effective market and promising government, and actively play the role of carbon market and other market-oriented emission reduction mechanisms. If the assessment results of

relevant provinces (autonomous regions and municipalities directly under the Central Government) are affected by non-human factors such as major natural disasters and emergencies, the National Development and Reform Commission, together with relevant departments, shall make a comprehensive judgment, put forward suggestions on the assessment results according to the facts, and make a separate explanation in the report submitted to the Party Central Committee and the State Council. Chapter

VI Supplementary Provisions

Article 23 The SASAC of the State Council shall, with reference to these Measures, formulate an evaluation and assessment system for the implementation of the target tasks of carbon peak and carbon neutralization by central enterprises. Article

24 The National Development and Reform Commission shall be responsible for the interpretation of these Measures. Article

25 These Measures shall come into force as of the date of promulgation.
