18, Atlas official micro-announcement said that on the same day, Atlas Group (CSIQ) announced that Maxeon Solar Energy Company of the United States filed a lawsuit against Atlas Group against the remaining proceedings related to TOPCon battery technology patents in the United States. All have been resolved in favour of the Atlas Group.
Among them, Maxeon's previous patent infringement lawsuit against Atlas Group in the Federal District Court of the United States has been rejected by the court, and the relevant claims can not be brought again. At the same time, the United States Court of Appeals for the Federal Circuit has vacated the relevant portion of the United States Patent Trial and Appeal Board (PTAB) decision concerning Maxeon's remaining disputed claims. So far, the US litigation proceedings between the two sides around the relevant TOPCon patents have all ended. The two-and-a-half-year patent war between the

two sides has come to an end. In March
2024, Maxeon announced that it had filed a patent infringement lawsuit against Atlas Group in the Federal Court of the Eastern District of Texas, focusing on the alleged unauthorized use of its TOPCon solar cell technology. The patents involved are US8222516, US8878053 and US11251315 respectively. Maxeon requests Atlas Group and related companies to stop infringement and compensate for losses and expenses.
However, in May 2025, Maxeon voluntarily withdrew Atlas's claim of infringement of US11251315 patent and retained the claim of infringement of the remaining two patents.
As for the claim of infringement, Atlas believes that its products and processes are obviously different from Maxeon's patented technology and do not constitute infringement of related patents. In June 2024, Atlas fought back. The company filed a patent invalidation application (IPR) with the United States Patent and Trademark Office (USPTO) to confirm the invalidation of the above three patents. In January
2025, the United States Patent and Trademark Office (USPTO) made a decision on the filing and examination of all three patents, and preliminarily considered that at least one Claim of the relevant patents might be invalid.
Finally, in January 2026, the United States Patent Trial and Appeal Board made a final decision on the validity of the TOPCon battery patent involved in the case: it found that a number of patent invalidity claims made by Atlas Group were established. Declare the claims of Maxeon in the United States for the patents used to sue Atlas Group invalid .
