cement plays a key role in construction and infrastructure construction, ranging from national projects, bridges, roads, factories to family life, and is an important support for improving living conditions, harnessing the ecological environment and developing circular economy. Recently, a counterfeit cement black workshop with clear division of labor and covert operation across provinces has finally fallen into the net of justice.
The case reviews
that the defendant Zhou Mouwu has been engaged in the production and sale of counterfeit "conch brand" cement for a long time. Since 2016, it has repeatedly changed its counterfeit manufacturing sites, hiding in the simple storage yard of the urban-rural junction, and using old equipment to fill bulk cement. Faced with administrative law enforcement, Zhou Mouwu took the way of "guerrilla warfare" to deal with it, and often relapsed as soon as the fine was paid. In November 2024, after the Minhang District Market Supervision and Administration Bureau imposed administrative penalties on him, the public security organs and the market supervision departments jointly seized a large number of sales documents in his business premises the following month, and Zhou Mouwu and others confessed their illegal acts on the spot. However, during the period of bail pending trial, Zhou Mouwu was still lucky to start filling counterfeit cement again. On June 13, 2025, with the approval of the Third Branch of Shanghai Procuratorate, he was arrested by the Shanghai Public Security Bureau according to law.
After examination according to law, it was found that from July 2022, the defendant Zhou Mouwu, without the permission of the owner of the registered trademark, entrusted the defendants Chen Mou-mou and Cui Mou-mou to print packaging bags with the registered trademark of "Conch" brand, and then hired Zhou Moutao and others to pour bulk cement of other brands. In the name of "Conch" brand P.C42.5 bagged cement, it is sold at a price of about 330 yuan per ton (including freight). After auditing, the defendant Zhou Mouwu sold more than 1900 tons of counterfeit "conch" brand bagged cement, totaling more than 610000 yuan, and the defendants Chen Moumou and Cui Moumou provided Zhou Mouwu with more than 510000 counterfeit "conch" brand cement bags. On December 30,
2025, the Third Branch of Shanghai Procuratorate filed a public prosecution with the Third Intermediate People's Court of Shanghai for the crime of counterfeiting registered trademarks by four people, including Zhou Mouwu. On January 20, 2026, after a public hearing, the court adopted all the charges and sentencing recommendations of the procuratorial organs, ruled that the four defendants committed the crime of counterfeiting registered trademarks, sentenced the defendant Zhou Mouwu to three years'imprisonment and a fine of RMB 200,000 yuan, and sentenced the remaining three defendants to one year, nine months to one year's imprisonment, suspended sentences and fines. No appeal was filed by the defendant, and the judgment has entered into force. In the process of
handling the case, the prosecutor learned that the phenomenon of manufacturing and selling counterfeit bagged cement similar to this case has been prohibited repeatedly, and that the channels for counterfeiters to purchase bulk cement mainly come from the bulk cement transit depot at Shanghai wharf. Some enterprises involved in the member units of Shanghai Cement Industry Association neglected to examine the qualifications and uses of purchasers in the sales process, and inadvertently provided the source of raw materials for counterfeiters. To this end, the procuratorial organs took the initiative to visit and investigate the Shanghai Cement Industry Association and the Interior Decoration Industry Association to understand the current situation of the production, circulation, sale, use and supervision of the cement industry in this city, and to control and self-discipline at the source of bulk cement, enhance the ability of consumer terminal identification, and coordinate supervision and crackdown across departments. Industry associations should recognize and continue to promote the implementation of rectification.
The prosecutor pointed out that
counterfeit cement not only directly damages the legitimate rights and interests of brand owners and disrupts the market environment of fair competition, but also deserves vigilance that the production and filling environment is poor, without any means of quality testing, and the key indicators of cement strength and stability can not be guaranteed. The counterfeit cement involved in the case mainly flows into the home decoration market and the landscape field. Although it is not used in the main project, it is easy to cause potential safety hazards such as wall cracking, tile hollowing and falling off. It is suggested that practitioners in relevant industries should strictly examine and verify the authorization qualification, and do not take risks because of the interests of orders; consumers should be alert to the "famous brand" products which are obviously lower than market price when purchasing building materials, and verify the authenticity through regular channels in time to protect the first line of defense for living safety.
