Recently, 11 cement companies in India were punished by the country's Competition Commission for their cartelization (that is, the formation of a cartel). Ten of them have appealed to the court for adjustment.
It is understood that the companies appealed to the court last week and will be heard on September 13. Earlier, the Competition Commission of India investigated 39 cement companies in the country at the request of the Builders Association of India, an organization of engineering design and construction contractors. In June, the Competition Commission of India imposed a fine of 63.07 billion rupees on 11 cartelized cement companies, equivalent to 50% of their average profits for the 2010 and 2011 fiscal years. The Competition Commission also imposed a nominal fine on the Indian Cement Producers Association, instructing it to stop collecting information on prices, shipments and products and to stop passing it on to its members.
The Competition Commission of India has asked the companies, which include ACC, Ambuja Cement, UltraTech Cement and Jaiprakash Associates, to pay the fine within three months.
